Terms & Conditions

By accessing or using the Jack mobile application, website, or related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform. Jack Hauling LLC ("Jack," "we," "our," or "us") reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Jack is a two-sided marketplace platform that connects customers ("Customers") who need hauling, junk removal, or related services with independent contractor drivers ("Drivers") who perform those services. Jack does not itself perform hauling services. We provide the technology platform to facilitate connections between Customers and Drivers. Jack is not a transportation company, freight broker, or employer of Drivers.

You must be at least 18 years of age to use the Platform. By creating an account, you represent and warrant that: • You are at least 18 years old • You have the legal capacity to enter into a binding agreement • All information you provide is accurate and up to date • You are not prohibited from using the Platform under applicable law

To access most features of the Platform, you must register for an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your login credentials secure and confidential • Notify us immediately of any unauthorized use of your account • Accept responsibility for all activities under your account Jack reserves the right to suspend or terminate accounts that violate these Terms.

Individuals who register as Drivers must meet the following requirements before accepting jobs: • Valid government-issued driver's license • Proof of auto insurance meeting minimum state requirements • Completion of a background check consent and review • A suitable vehicle capable of performing the listed services • Completion of platform onboarding and certification Jack reserves the right to approve, reject, suspend, or remove any Driver at its sole discretion. Drivers are independent contractors, not employees, agents, or partners of Jack.

Customers post jobs with a description, photos, pickup/destination, and pricing preferences. Drivers may submit bids on open jobs. Customers may accept, reject, or counter bids. Upon bid acceptance: • A binding service agreement is created between the Customer and Driver • The Customer is required to pay a deposit to confirm the booking • The balance is due upon job completion • Jack facilitates payments as a payment processor on behalf of the parties Jack does not guarantee job availability, Driver response times, or that any particular job will be completed.

All payments are processed through Stripe, a third-party payment processor. By using the Platform, you agree to Stripe's terms of service. Platform Fee: Jack charges Drivers a service fee (currently 15% of the total job price) deducted automatically from each completed job payout. This fee may change with notice. Tips: Customers may optionally add a tip after job completion. Tips are passed 100% to the Driver. Refunds: Refunds are handled on a case-by-case basis. Contact admin@jackhauling.com for disputes. Driver Payouts: Drivers receive payouts to their connected Stripe account, typically within 2–5 business days of job completion.

Either party may cancel a booking before the job begins. Cancellation policies and any applicable fees are determined at the time of booking. If a dispute arises between a Customer and Driver regarding job completion, quality, or pricing, either party may open a dispute through the Platform. Jack will review the dispute and may make a final determination at its sole discretion. Jack's decision on disputes is final and binding on both parties as a condition of using the Platform.

Drivers using Jack are independent contractors, not employees, joint venturers, partners, or agents of Jack Hauling LLC. Jack does not: • Control the manner or means by which Drivers perform services • Provide Drivers with tools, equipment, or vehicles • Set Drivers' work hours or schedules • Withhold taxes from Driver payments Drivers are solely responsible for all applicable taxes, insurance, licensing, and compliance with federal, state, and local laws.

You agree not to use the Platform to: • Violate any applicable law or regulation • Post false, misleading, or fraudulent job listings or bids • Harass, threaten, or harm other users • Circumvent the Platform's payment system by arranging off-platform payments • Upload malicious code, spam, or unauthorized advertising • Impersonate any person or entity • Collect user data without consent Violations may result in immediate account termination and, where applicable, legal action.

After each completed job, Customers and Drivers may leave ratings and reviews. You agree that: • Reviews must be truthful and based on genuine experience • You will not post defamatory, abusive, or fraudulent reviews • Jack may remove reviews that violate these Terms Jack does not endorse any reviews and is not responsible for their content.

All content on the Platform, including but not limited to text, graphics, logos, software, and design, is owned by Jack Hauling LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written permission. You grant Jack a non-exclusive, worldwide, royalty-free license to use, display, and distribute any content you upload to the Platform (such as job photos and profile images) for the purpose of operating the Platform.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy. Please review our Privacy Policy at jackhauling.com/privacy-policy.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Jack does not warrant that: • The Platform will be error-free or uninterrupted • Any Driver will meet your specific needs or expectations • Jobs will be completed to your satisfaction • The Platform is free of viruses or harmful components TO THE MAXIMUM EXTENT PERMITTED BY LAW, JACK DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JACK HAULING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. In no event shall Jack's total liability to you exceed the greater of (a) the amount paid by you to Jack in the twelve months preceding the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow the limitation of liability, so the above may not apply to you.

You agree to indemnify, defend, and hold harmless Jack Hauling LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from: • Your use of the Platform • Your violation of these Terms • Your violation of any third-party rights • Any dispute between you and another user • Any damage to property or injury to persons caused during the performance of services

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. • Arbitration will take place in South Carolina or via video conference • The arbitrator's decision will be final and binding • YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION You may opt out of arbitration within 30 days of first accepting these Terms by emailing admin@jackhauling.com with the subject line "Arbitration Opt-Out."

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any legal actions not subject to arbitration shall be brought exclusively in the state or federal courts located in South Carolina.

Jack reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting admin@jackhauling.com. Termination does not relieve you of obligations incurred prior to termination, including outstanding payments.

Entire Agreement: These Terms, together with the Privacy Policy and Independent Contractor Agreement (for Drivers), constitute the entire agreement between you and Jack regarding use of the Platform. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Waiver: Failure by Jack to enforce any provision of these Terms does not constitute a waiver of that provision. Assignment: You may not assign your rights under these Terms without Jack's prior written consent. Jack may assign its rights freely.
